1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you and BetterSEM ("Company", "we", "our", or "us") concerning your access to and use of the IndexQ website and services located at indexq.co (the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Service.
2. Description of Service
IndexQ provides the following services:
- URL Indexing: Submission of URLs to Google Indexing API and IndexNow protocol (Bing, Yandex, and other participating search engines)
- Auto-Indexing: Automatic discovery and submission of new URLs from your sitemaps
- Index Tracking: Monitoring the index status of your URLs via Google URL Inspection API
- Site Monitoring: Uptime monitoring, SSL certificate tracking, and broken link detection
- AI Exports: Generation of llms.txt and AI sitemap files for AI discoverability
- Notifications: Email, Slack, and Microsoft Teams alerts for various events
We facilitate URL submissions to search engines but do not guarantee that any URL will be indexed. Indexing decisions are made solely by the respective search engines.
3. Account Registration
To use IndexQ, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information
- Keep your password secure and confidential
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized access or security breach
You must be at least 18 years old to create an account. By creating an account, you represent that you are at least 18 years of age.
4. Acceptable Use
You agree not to use the Service to:
- Submit URLs for websites you do not own or have authorization to manage
- Submit URLs containing spam, malware, phishing, or illegal content
- Violate Google Search Console Terms of Service or IndexNow guidelines
- Circumvent rate limits or usage quotas
- Interfere with or disrupt the Service or servers
- Attempt to gain unauthorized access to any part of the Service
- Use the Service for any illegal or unauthorized purpose
- Resell or redistribute the Service without our written consent
We reserve the right to suspend or terminate accounts that violate these terms.
5. Google Search Console Authorization
To use certain features, you must connect your Google Search Console account and grant IndexQ access to your properties. You represent that you have the authority to grant this access and that your use of IndexQ complies with Google's Terms of Service. You can revoke this access at any time through your Google account settings.
6. Subscription Plans and Billing
Free Plan: Limited features with no payment required. Subject to usage limits.
Paid Plans: Billed monthly via Stripe. Your subscription will automatically renew each billing period unless cancelled.
Cancellation: You may cancel your subscription at any time. Your access will continue until the end of the current billing period. No refunds are provided for partial months.
Price Changes: We may change our prices with 30 days notice. Continued use after a price change constitutes acceptance of the new price.
Upgrades/Downgrades: Plan upgrades take effect immediately. Downgrades take effect at the end of the current billing period.
7. Usage Limits
Each plan has specific limits on:
- Number of sites you can manage
- Daily URL submission quota
- Number of tracked URLs for index monitoring
- Access to features (AI exports, monitoring, etc.)
Google imposes a limit of 200 URL submissions per property per day via the Indexing API. IndexQ manages your queue to stay within this limit.
8. Intellectual Property
The Service and its original content, features, and functionality are owned by BetterSEM and are protected by international copyright, trademark, and other intellectual property laws. You retain ownership of any content you submit through the Service.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- Warranties of merchantability or fitness for a particular purpose
- Warranties that the Service will be uninterrupted or error-free
- Warranties that URLs submitted will be indexed by search engines
- Warranties regarding the accuracy of index status information
Search engine indexing decisions are made solely by Google, Bing, and other search engines. We do not control and cannot guarantee indexing outcomes.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BETTERSEM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
11. Indemnification
You agree to indemnify and hold harmless BetterSEM, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of another.
12. Termination
We may terminate or suspend your account immediately, without prior notice, for any reason, including:
- Breach of these Terms
- Fraudulent, abusive, or illegal activity
- Non-payment of fees
- Extended periods of inactivity
Upon termination, your right to use the Service will cease immediately. We may delete your data in accordance with our data retention policies.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Delaware.
14. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the modified Terms.
